Allgemeine Geschäftsbedingungen (AGB) der Graubündenrally
1. Anmeldung und Verbindlichkeit
Die Graubündenrally weist darauf hin, dass eine Anmeldung verbindlich ist. Bei einer Stornierung bis zu 60 Tage vor der Veranstaltung werden 50% der Teilnahmegebühr erstattet. Bei Stornierung weniger als 60 Tage vor der Veranstaltung erfolgt keine Rückerstattung der Teilnahmegebühr. Bei Stornierungen innerhalb von 60 Tagen vor der Veranstaltung bleibt die Teilnahmegebühr in voller Höhe fällig.
2. Verschiebung der Veranstaltung
Die Graubündenrally behält sich das Recht vor, die Veranstaltung bei schlechten Wetterbedingungen auf einen anderen Termin zu verschieben, sofern dies möglich ist. Sollte dies nicht möglich sein, wird die Anmeldegebühr nicht zurückerstattet.
3. Haftungsausschluss
Die Graubündenrally haftet in keiner Weise für Schäden, die den Teilnehmerfahrzeugen während der Veranstaltung entstehen, weder durch eigenes Verschulden noch durch äussere Einflüsse. Darüber hinaus ist der Teilnehmer für den ordnungsgemässen Zustand des Fahrzeugs verantwortlich. Die Graubündenrally übernimmt keine Verantwortung, wenn Ihr Fahrzeug aufgrund einer Polizeikontrolle immobilisiert wird.
4. Beschlagnahme des Fahrzeugs
Die Graubündenrally haftet nicht für die Beschlagnahme des Fahrzeugs durch die Polizei bei Geschwindigkeitsüberschreitungen, illegalen Modifikationen am Fahrzeug des Teilnehmers oder anderen unvorhergesehenen Ereignissen. Die Graubündenrally übernimmt keine Haftung für Diebstahl während der Veranstaltung und der Tour.
5. Ausschluss von Teilnehmern und rechtliche Massnahmen
Die Graubündenrally behält sich das Recht vor, Teilnehmer, die sich nicht an die Strassenverkehrsordnung (STVO) halten, insbesondere bei Rufschädigung der Graubündenrally, von der Veranstaltung auszuschliessen. Darüber hinaus behält sich die Graubündenrally das Recht vor, rechtliche Schritte einzuleiten, falls es aufgrund des Fehlverhaltens einzelner Teilnehmer zu negativen Auswirkungen kommt.
6. Führerscheinpflicht
Ein gültiger Führerschein ist obligatorisch und muss bei der Einlasskontrolle vorgelegt werden.
7. Alkohol- und Drogenverbot
Während der gesamten Graubündenrally gilt ein striktes Verbot von Alkohol und Drogen. Fehlverhalten führt zum Ausschluss von der Veranstaltung und zur Sperrung für zukünftige Veranstaltungen.
8. Einhaltung der Strassenverkehrsordnung
Während der gesamten Veranstaltung müssen die Strassenverkehrsordnungen der jeweiligen Länder beachtet und strikt eingehalten werden. Die Teilnehmer haften für eventuell entstehende Bussgelder.
9. Teilnahme auf eigene Gefahr
Die Teilnahme an der Graubündenrally erfolgt auf eigene Gefahr. Die Graubündenrally übernimmt keine Verantwortung für Verletzungen, Unfälle oder Schäden, die während der Veranstaltung auftreten.
10. Fahrzeugversicherung
Es liegt in der Verantwortung des Teilnehmers sicherzustellen, dass sein Fahrzeug ausreichend versichert ist, einschliesslich einer gültigen Kfz-Haftpflichtversicherung. Die Graubündenrally übernimmt keine Haftung für Schäden, die am Fahrzeug des Teilnehmers oder an Dritten verursacht werden.
11. Änderungen des Veranstaltungsprogramms
Die Graubündenrally behält sich das Recht vor, das Veranstaltungsprogramm, einschliesslich der Streckenführung, der Start- und Zielpunkte sowie der geplanten Aktivitäten, aus organisatorischen Gründen zu ändern. Die Teilnehmer werden über derartige Änderungen rechtzeitig informiert.
12. Verhalten der Teilnehmer
Die Teilnehmer werden gebeten, respektvoll und rücksichtsvoll gegenüber anderen Teilnehmern, Zuschauern, Anwohnern und der Umwelt aufzutreten. Jegliche Form von aggressivem, beleidigendem oder unsportlichem Verhalten ist untersagt und kann zum Ausschluss von der Veranstaltung führen.
13. Schutz geistigen Eigentums
Es ist den Teilnehmern untersagt, das Logo, die Marken oder sonstiges geistiges Eigentum der Graubündenrally ohne vorherige schriftliche Zustimmung zu verwenden. Die Teilnehmer stimmen zu, dass während der Veranstaltung möglicherweise Fotos und Videos gemacht werden, die von der Graubündenrally zu Werbe- und Promotionszwecken genutzt werden können.
14. Rücktritts- und Rückerstattungsbedingungen
Im Falle eines Rücktritts von der Teilnahme an der Graubündenrallye durch den Teilnehmer gelten folgende Rückerstattungsbedingungen:
· Bei Stornierung bis zu 60 Tage vor der Veranstaltung: 50% der Teilnahmegebühr werden erstattet.
· Bei Stornierung weniger als 60 Tage vor der Veranstaltung: Keine Rückerstattung der Teilnahmegebühr.
15. Mahngebühren bei Zahlungsverzug
Bei Zahlungsverzug gelten folgende Mahngebühren:
· Die erste Mahnung wird ohne Gebühr ausgestellt.
· Für die zweite Mahnung wird eine Gebühr von 30 Franken erhoben.
· Für jede weitere Mahnung wird ebenfalls eine Gebühr von 30 Franken berechnet.
Die Mahngebühren dienen dazu, die Kosten für die Verwaltung und Bearbeitung von Zahlungsverzögerungen abzudecken. Es ist wichtig, dass die Teilnehmer ihre Zahlungen fristgerecht leisten, um zusätzliche Kosten zu vermeiden.
Bitte beachten Sie, dass bei anhaltendem Zahlungsverzug nach der dritten Mahnung Inkasso-Massnahmen eingeleitet werden können.
16. Teilnahmeberechtigung
Die Teilnahme an der Graubündenrally steht nur volljährigen Personen mit gültiger Fahrerlaubnis offen. Minderjährige können nur in Begleitung eines erziehungsberechtigten Erwachsenen teilnehmen.
17. Haftungsausschluss für Mitfahrer
Die Graubündenrally übernimmt keine Haftung für Verletzungen, Unfälle oder Schäden, die Mitfahrern während der Veranstaltung entstehen. Mitfahrer nehmen auf eigenes Risiko teil und müssen diesbezüglich ihre eigene Versicherung abschliessen.
18. Verzicht auf Schadensersatzansprüche
Die Teilnehmer verzichten ausdrücklich auf jegliche Schadensersatzansprüche gegenüber der Graubündenrally, ihren Organisatoren, Mitarbeitern und Sponsoren, die aus der Teilnahme an der Veranstaltung resultieren könnten.
19. Haftungsausschluss für Veranstaltungsänderungen
Die Graubündenrally behält sich das Recht vor, das Veranstaltungsprogramm, die Route, die Start- und Zielpunkte sowie andere Details der Veranstaltung aus Gründen höherer Gewalt oder unvorhersehbarer Umstände zu ändern oder abzusagen. Die Teilnehmer haben keinen Anspruch auf Schadensersatz oder Rückerstattung in solchen Fällen.
20. Zustimmung zur Verwendung von Bild- und Videomaterial
Die Teilnehmer erklären sich damit einverstanden, dass während der Veranstaltung von ihnen Bilder und Videos gemacht werden, die von der Graubündenrally zu Werbe- und Promotionszwecken verwendet werden können, einschliesslich der Veröffentlichung auf Websites, in sozialen Medien und anderen Medienkanälen.
General Terms and Conditions of the Graubündenrally
1. Registration and Binding
The Graubündenrally informs that registration is binding. In case of cancellation up to 60 days before the event, 50% of the participation fee will be refunded. For cancellations less than 60 days before the event, no refund of the participation fee will be granted. In case of cancellations within 60 days befor the event, the participation fee remains fully due.
2. Postponement of the Event
The Graubündenrally reserves the right to postpone the event to another date in case of adverse weather conditions, if feasible. If this is not possible, the registration fee will not be refunded.
3. Disclaimer of Liability
The Graubündenrally is not liable for any damages to the participant's vehicles during the event, whether caused by their own fault or external influences. Furthermore, the participant is responsible for the proper condition of the vehicle. The Graubündenrally assumes no responsibility if your vehicle is immobilized due to a police control.
4. Seizure of the Vehicle
The Graubündenrally is not liable for the seizure of the vehicle by the police due to speeding, illegal modifications to the participant's vehicle, or other unforeseen events. The Graubündenrally assumes no liability for theft during the event and the tour.
5. Exclusion of Participants and Legal Measures
The Graubündenrally reserves the right to exclude participants who do not comply with traffic regulations (STVO), especially those who damage the reputation of the Graubündenrally, from the event. Furthermore, the Graubündenrally reserves the right to take legal action if the misconduct of individual participants has negative consequences.
6. Driver's License Requirement
A valid driver's license is mandatory and must be presented at the entrance control.
7. Alcohol and Drug Prohibition
A strict prohibition of alcohol and drugs applies throughout the Graubündenrally. Misconduct will result in exclusion from the event and prohibition from future events.
8. Compliance with Traffic Regulations
Throughout the entire event, participants must comply with the respective countries' traffic regulations and strictly adhere to them. Participants are liable for any fines incurred.
9. Participation at Own Risk
Participation in the Graubündenrally is at your own risk. The Graubündenrally assumes no responsibility for injuries, accidents, or damages that occur during the event.
10. Vehicle Insurance
It is the participant's responsibility to ensure that their vehicle is adequately insured, including valid third-party liability insurance. The Graubündenrally assumes no liability for damages caused to the participant's vehicle or third parties.
11. Changes to the Event Program
The Graubündenrally reserves the right to change the event program, including the route, start and finish points, and planned activities for organizational reasons. Participants will be informed about such changes in a timely manner.
12. Participant Conduct
Participants are requested to act respectfully and considerately towards other participants, spectators, residents, and the environment. Any form of aggressive, offensive, or unsportsmanlike behavior is prohibited and may result in exclusion from the event.
13. Protection of Intellectual Property
Participants are prohibited from using the logo, trademarks, or other intellectual property of the Graubündenrally without prior written consent. Participants agree that photos and videos may be taken during the event, which may be used by the Graubündenrally for advertising and promotional purposes.
14. Cancellation and Refund Conditions
In case of cancellation of participation in the Graubündenrally by the participant, the following refund conditions apply:
· Cancellation up to 60 days before the event: 50% of the participation fee will be refunded.
· Cancellation less than 60 days before the event: No refund of the participation fee will be granted.
15. Late Payment Reminder Fees
The following late payment reminder fees apply:
· The first reminder will be issued without a fee.
· A fee of 30 Swiss francs will be charged for the second reminder.
· A fee of 30 Swiss francs will also be charged for each subsequent reminder.
The reminder fees are intended to cover the costs of managing and processing payment delays. It is important for participants to make their payments on time to avoid additional costs.
Please note that if payment is not made following the third reminder, debt collection measures may be initiated.
16. Eligibility for Participation
Participation in the Graubündenrally is only open to adults with a valid driver's license. Minors can participate only when accompanied by a legal guardian.
17. Disclaimer of Liability for Passengers
The Graubündenrally assumes no liability for injuries, accidents, or damages incurred by passengers during the event. Passengers participate at their own risk and must obtain their own insurance in this regard.
18. Waiver of Claims for Damages
Participants expressly waive any claims for damages against the Graubündenrally, its organizers, employees, and sponsors that may arise from participating in the event.
19. Disclaimer of Liability for Event Changes
The Graubündenrally reserves the right to change or cancel the event program, route, start and finish points, and other event details due to force majeure or unforeseeable circumstances. Participants have no right to compensation or refund in such cases.
20. Consent for Use of Image and Video Material
Participants agree that images and videos of them may be taken during the event, which may be used by the Graubündenrally for advertising and promotional purposes, including publication on websites, social media, and other media channels.
